Terms and Conditions for the consumer
1. Contract Conclusion / Cost
You will receive an automated confirmation e-mail from our shop system as soon as you have sent your purchase order. If your purchase order was made using debit entries your order will be processed immediately. All other purchase orders will be processed in sequence of incoming payment.
The agreement of sale comes into effect as soon as you have received the automated e-mail confirming your purchase order. All costs in our shop are in Euro and inclusive of the statutory VAT/GST.
All offers are subject to change in consequence of technical alterations. We also reserve the right to increase prices subject to market demand. We do not request a minimum order value.
We will refund any cost for goods that have been available when ordered but are unavailable or out of stock at the time of delivery.
2. Discount:
We warrant a 5% discount on any order value after your second order with us.
3. Postage and Packing
We will dispatch insured packages only (Insurance cost 520,00 €) with DPD.
DPD postage fees are according to our dispatch conditions.
Damage of dispatched items: Please check for any damage on receipt of your order. Unless complaints or damages have been reported immediately on acceptance of your order and documented using the appropriate delivery receipt, the haulage contractor will not compensate for any damages that occured in transport.
4. Delivery / Time of Delivery
Delivery will be carried out subject to delay of production, incorrect receipt of goods and delay of dispatch or transport of products to our shop. No compensation is granted for late or incomplete delivery unless this is due to gross negligence. You will be informed immediately of any delay or unavailability of any goods and we will reimburse any payment made by prepayment.
Unless agreed otherwise and depending on availability, your order will be sent immediately after receipt of your order.
5. Subsequent Delivery
No subsequent delivery will be carried out in case of unavailability of any product, unless this has been agreed. The product will have to be re-ordered.
6. Terms of Payment / Bank Details
Payment of your order can be carried out by pre-payment, debit entry, cash on delivery or credit card. We reserve the right to rule out any means of payment in certain cases. The settlement of an account is due immediately. We will charge all arising collection expenses and legal interest should a delay in payment occur.
You will be charged any expenses that occured to us due to wrong bank details given when paying by direct debit.
7. Right of Withdrawl
Provided that you act as consumer, you have the right to cancel your order immediately in writing (i.e. mail, fax or e-mail) or within two weeks after receipt of your order by return of goods. You will receive a separate document advising you of your power of revocation with your order, this is also the start of the two week term to return the goods to ensure the cancellation of the contract.

Revocation Sequence:
In the event of a valid revocation of the agreement each party shall return to the respective other party the benefits received. If you are unable to return the goods or part of the goods or are only able to return the goods in downgraded condition you will be made liable for a value replacement. This will not apply if the downgrade is due to inspection as possible in a retail outlet or due to failure when used as directed.
Goods that can be send can be returned at suppliers risk. Items that should not be send will be picked up. You will carry the expense for postage if the delivered goods are the goods that have been ordered, if the goods to be returned do not exceed the cost of 40 Euro or if no payment or only an agreed part payment has been made at the time of revocation for higher priced goods. In any other case the postage will be carried by us. In any other case postage will be free.
You are liable to rebate any payment within 30 days of return of your revocation of your agreement.
8. Other Exceptions:
Literal mistakes, means of delivery and change of product price are subject to change. Colourcards: due to technical reasons a true to the original demonstration or illustration is not possible. The reproduction of colour is different from one computer to another. All measurements, dimensions or specifications are approximate.
9. Reservation of Title / Property Right
All goods are property of the company M&K Tick Trading until payment has been completed.
10. Warranty / Guarantee
Any warranty claim by the consumer is at subject to supplementary performance. If the supplementary performance fails or if it is unacceptable, the client shall have the right to claim reduction in price or terminate the contract.
11. Transfer of Risk
Any risk will be transfered to the consumer after dispatch of the order.
12. Data Protection
All customer specific data (i.e. credit card details, name etc) will be transfered seperately via SSL. This will make it virtually impossible for any outsider to aquire data for illegal use. Credit card numbers will not be retained! All address data is protected by the data protection act and will not be passed onto any third party.
If you do not agree with the recording of any of your data we will delete those on request.
13. Address for Service and Place of Performance:
Address for service and place of performance for both parties is the registered office for the company M&K Tick-Trading or alternatively the district court Kamenz. Only german law applies.
14. Severability Clause:
Should this agreement contain a gap or should a provision thereof be or become wholly or partially unenforcable, the rest of the agreement shall remain enforcable.
